The short version. ML4HF™ is clinical decision support for licensed healthcare professionals. It is not a medical device, is not FDA-cleared, and is not a substitute for clinical judgment. Do not use it for emergency or time-critical decisions, and do not enter Protected Health Information.
1. Acceptance of these terms
These Terms of Service ("Terms") govern your access to and use of the ML4HF™ iOS application, the websites at ml4hf.app and ml4hf.ai, and any related services (the "Services") operated by PACDynamic ("we", "us"). By creating an account, downloading the app, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
2. Intended use
ML4HF™ is intended for use by qualified, licensed healthcare professionals as an adjunct to — and not a replacement for — independent clinical judgment. ML4HF™ outputs are informational only. They are not a diagnosis, prescription, or treatment recommendation.
ML4HF™ is not intended for emergency decision-making, code-team workflows, or any time-critical clinical decision. ML4HF™ is not FDA-cleared or approved as a medical device. ML4HF™ does not acquire, process, or analyse medical images or signals from in vitro diagnostic or pattern-recognition signal-acquisition systems.
3. Eligibility
You may use ML4HF™ only if you are: (a) a licensed healthcare professional or a trainee under appropriate clinical supervision; (b) at least 18 years of age; and (c) able to form a binding contract under the laws of your jurisdiction. By acknowledging the in-app disclaimer or signing in to your account, you represent that you meet these eligibility requirements.
4. Your account
You are responsible for the accuracy of the information in your account, for the security of your device, and for all activity that occurs under your account. You agree to notify us promptly of any unauthorised use of your account at rohan@pacdynamic.com.
5. Acceptable use
You agree not to:
- Enter Protected Health Information (PHI) or any directly-identifying patient data into the Services.
- Use the Services for emergency decision-making or as the sole basis for any clinical action.
- Reverse-engineer, decompile, or attempt to extract the source code or model weights of the Services, except to the extent expressly permitted by applicable law.
- Resell, rent, sublicense, or otherwise commercially redistribute the Services without our prior written consent.
- Use the Services to harass, harm, or violate the rights of any individual or to violate any applicable law or regulation.
- Submit case data on behalf of a patient without an appropriate clinical relationship and the disclosures required by your institution and jurisdiction.
- Circumvent any security, rate-limiting, or access-control mechanisms of the Services.
6. Data sharing and de-identification
By default, ML4HF™ shares the anonymous hemodynamic inputs and computed indices from your cases with PACDynamic to refine the underlying model. ML4HF™ does not request and does not transmit patient names, MRNs, room numbers, hospitals, or any other patient identifier. You may opt out of data sharing at any time in Settings → Data Sharing. 7. Intellectual property
The Services, including all software, content, visual design, brand assets, and trademarks ("ML4HF", "PACDynamic", and the heart-waveform mark) are the property of PACDynamic and are protected by U.S. and international intellectual-property law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services solely for their intended clinical-decision-support purpose, subject to these Terms.
You retain ownership of any case data you enter. By enabling data sharing, you grant us a perpetual, irrevocable, royalty-free license to use the anonymous hemodynamic inputs and computed indices for model training, validation, and research, including in aggregated form in peer-reviewed publications.
8. Third-party services
The Services may interact with third-party services (e.g., the Apple App Store, Apple Push Notification service, the NPPES public registry). Your use of those services is governed by their respective terms. We are not responsible for third-party services, and their availability is not guaranteed.
9. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT THE OUTPUTS WILL BE ACCURATE FOR ANY INDIVIDUAL PATIENT. ML4HF™ OUTPUTS ARE PROBABILISTIC ESTIMATES DERIVED FROM A COHORT-TRAINED MODEL; INDIVIDUAL PATIENT TRAJECTORIES MAY DIVERGE.
USE OF ML4HF™ DOES NOT CREATE A CLINICIAN–PATIENT RELATIONSHIP BETWEEN PACDYNAMIC AND ANY INDIVIDUAL PATIENT OR END USER.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PACDYNAMIC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES — INCLUDING ANY CLINICAL DECISIONS MADE IN RELIANCE ON ML4HF™ OUTPUTS — WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS.
11. Indemnification
You agree to defend, indemnify, and hold harmless PACDynamic and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or debt arising from (a) your use of the Services in violation of these Terms; (b) your violation of any applicable law or regulation; or (c) your violation of any third-party right, including any clinical, privacy, or intellectual-property right.
12. Termination
We may suspend or terminate your access to the Services at any time, with or without cause, including for violations of these Terms. You may stop using the Services at any time by deleting the app from your device. Provisions that by their nature should survive termination (intellectual property, disclaimers, limitations of liability, indemnification, governing law) will survive.
13. Changes to these terms
We may revise these Terms from time to time. Material revisions will be communicated via the in-app announcement bell and a notice on this page. Your continued use of the Services after revisions take effect constitutes your acceptance of the revised Terms. The "Effective" date at the top reflects the current version.
14. Governing law and dispute resolution
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms shall be resolved in the state or federal courts located in Duval County, Florida, and you consent to the personal jurisdiction of those courts.
